Police foil attempted alleged rental scam

Feb. 12, 2015- An Oak Park police officer posing as the relative of a potential renter led to charges against two men after they allegedly tried to collect rent and a security deposit on a vacant Oak Park house they did not own or manage.

Charged Tuesday (Feb. 10) with felony attempted theft by deception were Emmanuel C. Rice, 23, of the 100 block of Main Street in Chicago Heights, and James D. Gavin, 26, of the 3700 block of West 86th Street in Chicago.

The apparent scam began to unravel when the victim, a 24-year-old Chicago woman, became suspicious after a tour of the house and contacted Oak Park police. She said the pair had insisted on payment by cash, told her to change the locks after she moved in and not to be concerned should a real estate agent show up and tell her to move.

The victim told police the situation developed after one of the suspects with whom she was briefly acquainted learned that she was looking for an apartment to rent. She said the suspect claimed his brother was a real estate agent with a house for rent in Oak Park.

The house on the 800 block of Mapleton Avenue was vacant, but had been sold and the closing was scheduled. Police later learned that the property listing agent’s key lock box had been removed, a pry tool used to gain entry and the rear door lock changed.

The victim arranged to meet the suspects at the house to pay $800 for the first month’s rent, a $2,000 security deposit and sign a lease. An Oak Park police officer posing as a relative accompanied the victim to the vacant house. Once the cash had changed hands and a lease signed, Rice and Gavin were taken into custody.

The pair are being held pending a bond hearing.
