Oct. 27, 2017 – The revocation of the business license of Austin Pantry, 1 Chicago Ave. has been upheld by the Business License Appeal Board.
In a unanimous vote Thursday, the Appeal Board consisting of three Village Board Trustees ruled that the administrative decision by the Village Manager last month to revoke the license should stand.
The business had been closed since Aug. 31 due to heroin being found by Oak Park and Chicago police during the execution of a search warrant following a joint undercover investigation into allegations of illegal activity.
Following the search, Oak Park Police arrested Edgar L. Lucas, 55, of the 300 block of N. Latrobe Avenue in Chicago, who was identified as a store employee. The Cook County State’s Attorney charged Lucas with 17 felony counts of unlawful delivery of a controlled substance.
The Village Manager conducted an administrative hearing on Thurs., Sept. 14, to review the police investigation of the business and to hear from the business owner and legal counsel, a process established by Village Code. After review of the testimony and evidence presented through the hearing process, the business license was revoked on Sept. 18.
The business owner appealed the administrative decision to the Village Board, which convened the Business License Appeal Board to hear the appeal on Thursday. The Appeal Board ruled that the Village Manager had determined correctly that activity at the store created a public nuisance and the business license should continue to be revoked permanently.
